This AUP is designed to protect Nondy Enhance, our users, and the broader community from illegal, harmful, or abusive use of the Service. We reserve the right to enforce this policy at our sole discretion and to suspend or terminate accounts that violate these guidelines.

2. Permitted Uses

You may use the Service for lawful purposes, including but not limited to:

  • Enhancing your own original videos and images for personal or commercial use
  • Processing content for which you own all rights or have obtained proper licenses
  • Creating social media content, marketing materials, educational content, or artistic projects
  • Improving the quality of user-generated content for legitimate business purposes
  • Enhancing content in compliance with applicable copyright and intellectual property laws

3. Prohibited Content

You may not upload, share, process, or create content using the Service that:

3.1 Illegal Content

  • Violates any local, national, or international law or regulation
  • Promotes, facilitates, or depicts illegal activities or criminal conduct
  • Contains child sexual abuse material (CSAM) or any content sexualizing minors
  • Facilitates human trafficking, exploitation, or modern slavery
  • Promotes terrorism, violent extremism, or organized criminal activity
  • Contains instructions for creating weapons, explosives, or dangerous substances

3.2 Intellectual Property Violations

  • Infringes copyright, trademark, patent, trade secret, or other intellectual property rights
  • Contains unauthorized use of copyrighted music, video clips, images, or other media
  • Uses another person or entity branding, logos, or proprietary content without permission
  • Circumvents digital rights management (DRM) or other protective measures

3.3 Harmful or Dangerous Content

  • Depicts, glorifies, or encourages violence, self-harm, suicide, or eating disorders
  • Contains graphic depictions of death, serious injury, or bodily harm
  • Promotes dangerous activities or challenges that risk physical harm
  • Contains malware, viruses, ransomware, or malicious code

3.4 Hate Speech and Discrimination

  • Promotes hatred, violence, or discrimination based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or other protected characteristics
  • Contains slurs, epithets, or derogatory language targeting protected groups
  • Advocates for or glorifies supremacist ideologies or hate groups

3.5 Harassment and Abuse

  • Harasses, threatens, stalks, or intimidates individuals or groups
  • Bullies or targets individuals with abusive or demeaning content
  • Contains doxing (sharing private personal information without consent)
  • Depicts or promotes non-consensual intimate imagery ("revenge porn")

3.6 Sexual Content

  • Contains pornography or sexually explicit material
  • Depicts or promotes non-consensual sexual acts
  • Sexualizes minors in any way (zero tolerance policy)
  • Solicits or facilitates prostitution or sexual services

3.7 Misinformation and Fraud

  • Contains intentionally false, misleading, or deceptive information
  • Impersonates another person, organization, or entity
  • Promotes financial scams, pyramid schemes, or fraudulent investment opportunities
  • Spreads medical misinformation that could cause physical harm
  • Creates or manipulates content to deceive (including deepfakes without disclosure)

3.8 Privacy Violations

  • Violates the privacy rights of individuals depicted in the content
  • Contains unauthorized recordings or surveillance footage
  • Shares personal identifying information without consent

4. Prohibited Activities

In addition to content restrictions, you may not engage in the following activities:

4.1 Service Abuse

  • Attempt to reverse engineer, decompile, or extract source code from the Service
  • Use automated tools, bots, or scripts to access or interact with the Service
  • Overload, interfere with, or attempt to disrupt the Service or its infrastructure
  • Bypass, disable, or circumvent security features or access controls
  • Attempt to gain unauthorized access to accounts, systems, or networks

4.2 Account Misuse

  • Create multiple accounts to abuse promotions, circumvent restrictions, or evade bans
  • Share account credentials with others or allow unauthorized account access
  • Use stolen payment methods or fraudulent payment information
  • Engage in account resale or unauthorized commercial use

4.3 Commercial Spam

  • Use the Service to generate or distribute spam, phishing attempts, or unsolicited commercial messages
  • Mass-produce content for manipulative marketing or SEO spam purposes
  • Engage in affiliate link schemes or deceptive advertising practices

5. Content Ownership and Rights

By uploading content to the Service, you represent and warrant that:

  • You own all rights to the content or have obtained all necessary permissions, licenses, and consents
  • You have the right to grant Nondy Enhance the license described in our Terms of Service
  • All individuals depicted in the content have provided consent for their likeness to be used and enhanced
  • The content does not violate any third-party rights, including privacy, publicity, or intellectual property rights

6. Compliance with Laws

You must comply with all applicable laws and regulations when using the Service, including but not limited to:

  • Copyright and intellectual property laws
  • Privacy and data protection laws (including GDPR)
  • Export control and sanctions regulations
  • Consumer protection laws
  • Anti-discrimination and hate speech laws
  • Laws regarding defamation, libel, and slander

7. Enforcement

7.1 Monitoring and Investigation

We reserve the right, but are not obligated, to:

  • Monitor and review content uploaded to the Service
  • Investigate suspected violations of this AUP
  • Use automated systems to detect prohibited content
  • Cooperate with law enforcement and regulatory authorities

7.2 Actions We May Take

If we determine that you have violated this AUP, we may take any or all of the following actions:

  • Issue a warning and require removal of violating content
  • Delete or refuse to process content that violates this AUP
  • Temporarily suspend your account
  • Permanently terminate your account without refund
  • Report illegal activity to law enforcement or relevant authorities
  • Ban you from creating new accounts
  • Take legal action to recover damages or prevent further harm

The severity of the enforcement action will depend on the nature and severity of the violation, your history of compliance, and other relevant factors.

7.3 Appeals

If you believe your account was suspended or content was removed in error, you may appeal by contacting support@ndy-enhance.com with:

  • Your account email address
  • Description of the content or activity in question
  • Explanation of why you believe the action was incorrect
  • Any supporting evidence or documentation

We will review appeals within 7 business days. Our decision on appeals is final.

8. Reporting Violations

If you become aware of content or activities that violate this AUP, please report them immediately to abuse@ndy-enhance.com with:

  • Description of the violation
  • Account or content involved (if known)
  • Date and time of the violation
  • Any relevant screenshots or evidence

We take all reports seriously and will investigate promptly. We may not be able to provide specific details about our actions due to privacy considerations, but we are committed to enforcing this policy.

9. Copyright Infringement (DMCA)

If you believe your copyrighted work has been infringed, please submit a DMCA takedown notice to dmca@ndy-enhance.com with the following information:

  • Identification of the copyrighted work claimed to be infringed
  • Identification of the allegedly infringing material and its location
  • Your contact information (name, address, phone, email)
  • A statement that you have a good faith belief that the use is not authorized
  • A statement that the information in the notice is accurate
  • Your physical or electronic signature

We will respond to valid DMCA notices in accordance with applicable law.

10. User Responsibility

You are solely responsible for:

  • The content you upload and process through the Service
  • Ensuring compliance with this AUP and all applicable laws
  • Obtaining necessary rights, permissions, and consents
  • Your use of enhanced content after downloading
  • Any consequences resulting from your violations of this AUP

11. Changes to This Policy

We may update this AUP from time to time to reflect changes in our practices, legal requirements, or community standards. We will notify you of material changes via email or through a prominent notice on the Service. Your continued use of the Service after changes constitutes acceptance of the revised AUP.

While we strive to enforce this AUP and maintain a safe environment, we cannot guarantee that all content will comply with these guidelines. We are not responsible for content uploaded by users, and the presence of content on our Service does not constitute endorsement.
